1. Acceptance of Terms

By accessing and using the BESS SMS platform (\u201cService\u201d), operated by SITCA Caribbean, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

BESS SMS provides an enterprise messaging platform enabling users to send SMS and WhatsApp broadcasts via Twilio\u2019s API. The Service includes contact management, broadcast scheduling, delivery tracking, credit management, and reporting features.

3. Account Registration

You must provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to use the Service to:

  • Send unsolicited messages (spam) or violate any anti-spam legislation
  • Send messages containing illegal, harmful, threatening, or harassing content
  • Impersonate any person or entity
  • Violate the Twilio Acceptable Use Policy
  • Attempt to access another user\u2019s account or data

5. Credits & Billing

Message sending requires credits. Credits are pre-purchased and are non-refundable. Rates are determined per-country based on Twilio\u2019s pricing with applicable markup. Rates may change with prior notice.

6. Message Content

You are solely responsible for the content of messages sent through the Service. Messages must comply with all applicable laws, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and GDPR where applicable.

7. Opt-Out Compliance

The Service automatically processes STOP/UNSUBSCRIBE commands from recipients. You must honor all opt-out requests and not re-add opted-out contacts to your broadcasts.

8. Service Availability

We aim for high availability but do not guarantee uninterrupted service. Message delivery depends on third-party carriers and networks beyond our control.

9. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may request account deletion by contacting us at [email protected].

10. Limitation of Liability

To the maximum extent permitted by law, SITCA Caribbean shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service, including but not limited to lost profits or data.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service constitutes acceptance of updated Terms.
